4.6.1 The Loss of Constitutional Powers

It was stated that nuclear weapons subvert the rule of law since they are represented to be entirely defence related and thus, of no concern to the public. An action was brought in the US Federal Court for an injunction on the deployment of Cruise missiles but the action was dropped as an Order could not be put into effect; it was considered by the Court as a matter purely for the US Government.

Being above the law not only subverts the rule of law, but also subverts the constitutional system of government which depends on the rule of law.
